TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID TO US THROUGH THE SITE IN THE PRIOR THREE (3) MONTHS (IF ANY), WHICHEVER IS GREATER.

ARBITRATION CLAUSE — IMPORTANT — AFFECTS YOUR LEGAL RIGHTS.

Either you or we may elect to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Site through binding individual arbitration rather than in court.

• No class actions: You agree disputes will be brought only in your individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding.
• No jury trial: If arbitration applies, you waive your right to a trial by jury.
• Arbitration provider: Arbitration will be administered by AAA or JAMS under their applicable consumer rules, unless we mutually agree otherwise.
• Location: Unless required otherwise by law, arbitration will take place in Palm Beach County, Florida or in the federal judicial district where you reside (as applicable).
• Fees: Allocation of fees will follow the arbitration provider’s rules and applicable law; we will pay or reimburse certain fees as required by law or provider rules.
• Small claims: You may still bring qualifying claims in small claims court.

This arbitration provision survives termination of these Terms.
